Welcome to Lease Transfer (the "Platform"), a trading name of Apany LTD ("we", "us", "our"), a company registered in England and Wales with company number 15187824.
These Terms & Conditions ("Terms") set out the rights and obligations of all users ("you", "your") regarding the use of our website and services. By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Platform.
2. Our Service
Lease Transfer provides an online marketplace connecting existing vehicle lease holders ("Transferors") with individuals looking to take over a lease ("Transferees").
Important Notice: We act solely as an advertising and connection platform. We are not a lender, credit broker, or leasing company. We do not:
- Own, sell, or lease the vehicles listed.
- Make credit decisions or approve lease transfers.
- Guarantee that a lease transfer will be approved by your finance provider.
The final approval and transfer process is strictly between the Transferor, the Transferee, and the relevant Leasing Company (Finance Provider).
3. Eligibility
By using the Platform, you represent and warrant that:
- You are at least 18 years of age.
- You are a resident of the United Kingdom.
- You have the legal capacity to enter into binding contracts.
- All information you provide to us is accurate, current, and complete.
4. User Accounts
To access certain features, you may be required to register an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
You must notify us immediately of any unauthorised use or security breach. We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.
5. For Lease Holders (Transferors)
5.1 Listings
When listing a vehicle, you agree to provide accurate, honest, and up-to-date information regarding the vehicle's condition, mileage, monthly payments, and remaining lease terms. You must ensure you have the right to advertise the vehicle and that your leasing company allows transfers.
5.2 Fees
We charge a one-time listing fee of £34.99 to publish your vehicle on the Platform. This fee covers the creation and hosting of your advertisement.
- The fee is non-refundable once the listing is published, regardless of whether a transfer is successfully completed.
- We do not charge commission on the transfer itself.
- Your leasing company may charge their own separate administrative fees for processing the transfer, which are outside our control.
6. For Lease Takers (Transferees)
Browsing listings and contacting lease holders on the Platform is free. However, you acknowledge that:
- Taking over a lease is subject to credit approval by the leasing company.
- You may be required to pay administrative fees directly to the leasing company.
- You should independently verify the details of the vehicle and lease contract before signing any agreements.
7. Limitation of Liability
To the fullest extent permitted by law, Apany LTD excludes all liability for any loss or damage arising from your use of the Platform, including but not limited to:
- The accuracy or truthfulness of any listing.
- The failure of a leasing company to approve a transfer.
- Any financial loss, data loss, or consequential damages.
- Disputes between Transferors and Transferees.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.
8. Intellectual Property
All content on the Platform, including text, graphics, logos, and code, is the property of Apany LTD or its licensors. You may not reproduce, distribute, or create derivative works without our prior written consent.
9. Prohibited Conduct
You agree not to use the Platform to:
- Post unlawful, misleading, or fraudulent content.
- Harass, abuse, or spam other users.
- Infringe the intellectual property rights of others.
- Introduce viruses or harmful code.
We reserve the right to remove any content and suspend any user that breaches these Terms.
10. Changes to Terms
We may update these Terms from time to time to reflect changes in our business or legal requirements. Material changes will be notified to you via email or a prominent notice on the Platform. Your continued use of the Platform after such changes constitutes acceptance of the updated Terms.
11. Governing Law & Jurisdiction
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
